Terms of Use

0. Definitions

For the purposes of these Terms:

• "MetriQ" or "Service" — the MetriQ Golf mobile application, its features, content, APIs, and related documentation.
• "User" or "You" — any individual who creates an account or uses the Service.
• "Account" — the personal, non-transferable registration required to access the Service.
• "User Content" — information you input or generate in the app, including rounds, shots, training, notes, and recordings.
• "Coach" and "Athlete" — selectable roles during signup that define data visibility permissions.
• "Premium Plan" — paid subscription that unlocks additional features.
• "Stores" — Apple App Store and Google Play Store.

1. About the Service

MetriQ Golf is a mobile app for golf performance tracking and analysis, available on iOS and Android. It provides round logging, AI analysis, training tracking, goals, and athlete-coach connectivity.

2. Eligibility

• You must be at least 13 years old to create an account.
• Users between 13 and 18 require parental or legal guardian authorization.
• By accepting these Terms, you represent that you have the legal capacity to enter into this agreement.

3. User Account

• You are responsible for the confidentiality of your password and all activities under your account.
• Provide accurate, current, and complete information and keep it updated.
• You may not create fake, automated, or proxy accounts.

4. Plans and Payments

• MetriQ offers a free plan with basic features and a paid premium plan.
• Premium subscriptions are processed via Apple App Store or Google Play Store (managed via RevenueCat). Refund policies follow each store's rules.
• Premium plans auto-renew until cancelled. You may cancel at any time in your store settings.
• Prices and premium features may change with 30 days' prior notice.

5. Acceptable Use

Permitted:

• Log your own golf rounds, training sessions, and lessons
• Use AI analysis to improve your game
• Connect with coaches as an athlete
• Share performance data with your linked coach

Prohibited:

• Reverse engineering, decompiling, or copying the application
• Using MetriQ for illegal purposes or in ways that violate third-party rights
• Attempting to access other users' data without authorization
• Using the app to send spam, viruses, or harmful content
• Reselling or sublicensing access to the service
• Using bots, scrapers, or automated methods to extract app data

6. User Content

You retain ownership of data you enter into MetriQ (rounds, notes, recordings). By using the service, you grant us a limited license to process that data solely to operate and improve MetriQ, as described in our Privacy Policy.

We do not use your data to train third-party AI models without your explicit consent.

7. AI Features

You understand that:

• AI analysis outputs are suggestions, not professional golf coaching or health advice.
• AI results may contain inaccuracies. Do not rely solely on them for important decisions.
• Voice commands and audio lesson recordings are sent to third-party APIs (OpenAI, Anthropic, Groq) for processing.

8. Coach-Athlete Relationship

• Connections are established by explicit invitation and may be terminated by either party at any time.
• Linked coaches only access statistics and data the athlete has shared.
• MetriQ is not responsible for communications between coaches and athletes outside the app.

9. Service Availability

We strive to keep MetriQ available at all times but do not guarantee 100% uptime. We may suspend or modify features with reasonable prior notice. We are not liable for losses arising from temporary unavailability.

10. Intellectual Property

MetriQ, including its interface, design, algorithms, and source code, is the exclusive property of its creators and protected by copyright and intellectual property laws. These Terms do not transfer any ownership rights to users.

11. Disclaimer of Warranties

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, METRIQ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE PRIOR 12 MONTHS (OR $10 USD FOR FREE USERS).

13. Governing Law and Dispute Resolution

• US users: Laws of the State of California govern these Terms. Disputes shall be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules.
• Brazilian users: Brazilian law. Forum: consumer's domicile, under the CDC.
• Other countries: Brazilian law, São Paulo/SP forum.

14. Class Action Waiver (US Users)

You agree to resolve disputes through individual binding arbitration and waive any right to participate in class actions. This clause does not apply to small claims court matters or intellectual property disputes.

14a. DMCA Copyright Infringement Notice

We respect intellectual property rights. If you believe content on MetriQ infringes your copyright, send a written notice containing:

• Identification of the copyrighted work and the allegedly infringing material
• Your contact information (name, address, phone, email)
• Good-faith statement that the use is unauthorized
• Statement, under penalty of perjury, of accuracy and ownership
• Your physical or electronic signature

14b. Apple App Store Specific Terms

• These Terms are between you and MetriQ, not Apple Inc. Apple is not responsible for the Service.
• Apple has no obligation to provide maintenance and support for MetriQ.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple for a refund. Apple has no other warranty obligations.
• MetriQ (not Apple) is responsible for product claims, civil liability, and consumer protection law violations.
• MetriQ is solely responsible for third-party intellectual property infringement claims.
• You represent that you are not located in a US-embargoed country or listed on US Government prohibited parties lists.
• Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

14c. Google Play Store Specific Terms

For users who downloaded MetriQ from Google Play Store, the Google Play Developer Distribution Agreement applies in addition to these Terms.

15. Termination

You may close your account at any time in You → Delete Account. We may suspend or terminate your account for violations of these Terms, with prior notice when possible.

Before voluntarily terminating, we recommend exporting your data in You → My Data → Export.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and General Provisions.

15a. Electronic Consent (E-SIGN Act)

For users in the United States, by accepting these Terms electronically you consent to receive electronic communications under the E-SIGN Act.

15b. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and MetriQ.
• Assignment: You may not assign or transfer these Terms without our consent. We may assign freely.
• Severability: If any provision is held invalid, the remaining provisions remain in force.
• Waiver: Failure to enforce any provision does not constitute waiver.
• Force Majeure: We are not liable for non-performance due to events beyond our control.

16. Changes to Terms

We will notify you of material changes at least 15 days in advance via in-app notification or email. Continued use after the effective date constitutes acceptance.
